Preamble

These General Terms and Conditions of Sale apply to all orders placed on the Website "www.poopoopidoo.net"

These General Terms and Conditions of Sale are concluded on the one hand between
- The micro enterprise "Marie-Ange Tiers", whose registered office is located at 48 rte d'Angoulême, 16600 Magnac sur Touvre – France, registered with the Trade and Industry Register of Charente under number 512 854 712

Hereinafter referred to as 'Poopoopidoo'
And, on the other hand,
-By any natural or legal person (referred to as the "Buyer" or the "Customer") wishing to make a purchase via the Website "www.poopoopidoo.net"
The parties agree that their relations will be governed exclusively by this contract, to the exclusion of any condition previously available on the Site. However, if a condition were to be lacking, it would be considered to be governed by the practices in force in the distance selling sector of which the undertaking has its registered office in France.
The Customer acknowledges having, prior to any order, read all the above information and the General Terms and Conditions of Sale.

Article 1: object
Fields of application
These GTC are intended to define the contractual conditions (Rights and Obligations) between Poopoopidoo and the Customer, whether professional or consumer, in connection with the sale of products by Poopoopidoo through its online store.


-Duration of application and modifications of the General Conditions of Sale:
These GTC are valid from 15/03/2019.
Poopoopidoo reserves the right to adapt or modify these GTC at any time and without prior notice. In case of modification, it will be applied to each order the GTC in force on the day of the order.
Thus, the Customer must be at least 18 years old, be legally capable of contracting and use this Site.
The resale or distribution of products purchased on the Site is authorized without declawing.

Article 2 – Availability of Products

Product offers and prices are valid as long as they are visible on the Site, within the limits of available stocks. In case of unavailability of the products after placing the order, the Customer will be informed by email as soon as possible. Poopoopidoo will offer him the supply of a similar product at the same price. In the absence of acceptance, and if the debit of the payment has already occurred, he will proceed to its refund within a maximum period of 14 days.
Due to the specificity of the Internet, Poopoopidoo does not guarantee on its Site the availability of all products in real time. Due to the artisanal nature of the products, some are already in stock while others must be manufactured on request, which results in a manufacturing time of maximum 30 days for the individual. In case of need for additional time, Poopoopidoo will contact the customer by email to set a new date for sending the order.
The manufacturing time for the professional / reseller will depend on the quantity of orders already managed by poopoopidoo, the size of the order desired by the professional, the stock already available. The dealer must therefore contact Poopoopidoo before any order to know the approximate manufacturing time.

Article 3 – Geographical area of delivery
The products presented and sold on the Site may be delivered worldwide.
It is up to the Customer to check with the local authorities, the possibilities of importing or using the products he plans to order. The Customer understands and agrees that Poopoopidoo shall be released from any liability for this fact, and therefore no compensation shall be due to the Customer.

Article 4- Deactivation of the Customer account
Failure by the Customer to comply with the obligations subscribed to under these GTC, acts contrary to the interests of Poopoopidoo, may result in the suspension of access to the Site, or even the termination of his account depending on the degree of seriousness of the acts in question, without it being possible to claim damages or compensation whatsoever from Poopoopidoo.
Poopoopidoo reserves the right to refuse any order from a Customer with whom there is such a dispute, even if the Customer uses a new account.

Article 5 – Order confirmation
Any order placed with Poopoopidoo must be confirmed by Poopoopidoo for the order to be definitively accepted.
Indeed, Poopoopidoo reserves the right to cancel any order from a Customer with whom there is a dispute relating to the payment of a previous order, or other cases provided for in this contract.
The confirmation of the order will be sent by email to the Customer as soon as possible, subject to the provision by the Customer of a valid email address that is not subject to any restriction of use (professional email address for example). In this specific case, Poopoopidoo can not be held responsible for the non-receipt of the confirmation of the order containing all the contractual information and carrying proof of the transaction.

Article 6 – Price
Prices are valid as long as they are visible on the Site, within the limits of available stocks. Poopoopidoo reserves the right to modify prices at any time and undertakes to apply the rate in force on the date of validation of the order.
Prices are exclusive of VAT, which is not applied, due to the micro enterprise status of Poopoopidoo. The selling prices do not include shipping or insurance costs, invoiced in addition to the price of the products purchased according to the amount of the order.

For a delivery abroad, the Customer will have to pay any customs duties, or other taxes due on the occasion of the importation of the products in the country of the place of delivery. The formalities relating thereto are also the sole responsibility of the Customer.

Article 7 – Method of payment
-By credit card (Carte Bleue, Visa, Mastercard / Eurocard) via a secure payment interface offering maximum guarantees (secure entry by SSL encryption): by indicating directly in the area provided for this purpose the number of the card without spaces between the digits, its date of validity, as well as its control code;
-By PayPal. The Customer is then redirected to the PayPal platform and as such, he is subject to the conditions of use of the said platform; this also implies that no banking information concerning the Customer passes through the Site.
-By credit card in 3 times free of charge with the ALMA option


Article 8 – Retention of title
The documents and products provided to the Customer are governed by the Intellectual Property Code. They therefore remain the property of Poopoopidoo. It is therefore forbidden to reproduce the documents or products provided without the consent of Poopoopidoo.

Article 9 – Execution of the order
Poopoopidoo reserves the right to refuse the order for a "legitimate reason" (as defined by case law), and in particular (without this list being exhaustive) in the event of:
-unavailability of the product, abusive request of the Customer, presumption of impossibility for the Customer to contract or manifest intention for the Customer to harm Poopoopidoo
-fraud or attempted fraud relating to the use of the Site.
Poopoopidoo also reserves the right to refuse the order, in the event of an obvious typographical error leading to the display of a "low price". Poopoopidoo will contact the Customer again to find out if he wishes to maintain or cancel his order at the rate that will be communicated to him.
Finally, Poopoopidoo reserves the right to refuse the order in case of dispute with the Customer, total or partial non-payment of a previous order, refusal of bank authorization during the online payment process.
In all other cases Poopoopidoo undertakes to execute the order and send the good(s) to the Customer within 30 days, or longer period previously established (see Article 2)

Order Status:
-"Unprocessed" means that the order is well validated, but the order is being processed (in the process of being manufactured or prepared)

Article 10 – Invoicing
An invoice is automatically generated as soon as the Customer's order has been confirmed by Poopoopidoo.
The document recalls in particular i) the identification and contact details of Poopoopidoo, delivery costs, payment and delivery terms, the essential characteristics due to the product, the price, the address to which to submit complaints.

Article 11 – Delivery
The products are shipped to the delivery address indicated during the ordering process.
The customer is informed by email of the sending of the order.

I-Deliveries
A) Delivery via POST (standard delivery)
In case of absence of the recipient of the order during delivery, the carrier will leave a notice of passage and the customer or the recipient has 14 days to recover the package according to the terms indicated on the notice of passage. After this period, the order will be automatically returned to Poopoopidoo who will contact the Customer again to define the conditions of a possible reshipment. The processing costs of this new delivery will then be invoiced to the Customer.
Any defect or delay in sending (except prior agreement by email with poopoopidoo), beyond 30 days following the date of the order, must be reported as soon as possible. The Customer is then able to cancel his order, by registered letter with acknowledgment of receipt or in writing on another durable medium, if, after having ordered Poopoopidoo to make the delivery within a reasonable additional time, if the latter has not been executed within this period.
The contract will be deemed terminated upon receipt by Poopoopidoo of the letter or writing informing it of such termination, unless Poopoopidoo has performed in the meantime.
Poopoopidoo will refund the Customer no later than 14 days from the date on which the contract was terminated.
It is the Customer's responsibility to check the conformity of the goods delivered at the time of delivery and before signing the carrier's delivery note. The Customer must indicate on the delivery note and in the form of handwritten reservations accompanied by his signature, any anomaly concerning the delivery (open package, damaged product, etc.). This verification is considered to have been carried out when the Customer, or a person authorized by him, has signed the delivery note. Poopoopidoo invites the Customer to refuse the goods if the product(s) have been seriously damaged.

b) Delivery via MONDIAL RELAY:
To use Mondial relay, the customer must select this option at checkout. The choice of the relay point is made once the payment has been made.
The customer will be notified of the arrival of his package by email and / or SMS.
In case of cancellation of order, the shipping costs can only be refunded as long as the package has not been deposited in relay point. Once deposited, the shipping costs will remain the responsibility of the customer.
If it is impossible to deliver the package to the Relay® Point of destination, MONDIAL RELAY may deliver it to the nearest Relay® Point and notify the customer. No refund of the service can be made as a result.
The parcel is delivered to the customer on presentation of an identity document and against signature scanned on the Terminal of the Point Relais®. The signature on the electronic terminal as well as its reproduction, are proof of the delivery of the package to the recipient and the parties recognize to this signature a legal value identical to that of a handwritten signature.
Parcels are available at a Relay® Point for at least 7 calendar days, this period can be up to 14 calendar days, depending on the constraints of the activity and services chosen. . Packages are delivered to an agent of the customer upon presentation of an identity document of the agent and an identity document of the customer.
At the end of this period, the parcel will be sent by the Drop-off Relay® Point to the Expertise Service of Mondial Relay, 9 avenue Antoine Pinay 59510 HEM. The package will remain available to the Customer at this address for 1 month. The recovery of the parcel is the responsibility of the Customer. After this period of one month, Mondial Relay will be able to freely dispose of the package.
No claim concerning damage or delivery can be taken into account after a period of 3 days following the delivery notice mentioned by the centralized computer system of MONDIAL RELAY
In this case Poopoopidoo can not be held responsible for the non-recovery of a package, nor be required to compensate the customer.

c) Delivery by DELIVENGO
Delivengo is a tracking delivery method set up by post in partnership with Assendia for 0-2 kg goods for destinations outside the European Union
Delivery is made in mailbox.
The delivery time varies depending on the destination between about 7 and 30 days.

(d)Hand delivery
Poopoopidoo will contact the customer by email once the order is ready, to agree on a date of withdrawal of the order by the buyer, directly at the workshop, at 48rte d'Angoulême, 16600 Magnac sur Touvre -FRANCE

Article 12-Right of withdrawal (European Union)
In accordance with Article L 221-18 of the Consumer Code, the Customer has a period of 14 days (public holidays and Sundays included) to exercise his right of withdrawal without having to justify reasons or pay penalties with the exception, where applicable, of return costs. 14 days runs from the date of receipt of the products ordered.
Nevertheless, the Customer may not avail himself of this right in the following cases:
-"Supply of goods made to the consumer's specifications or clearly personalized"
-"Supply of goods manufactured on request"
-'Supply of goods which have been washed or used by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection'.
Poopoopidoo recommends that the Customer who wishes to exercise his right of withdrawal contact either by email by sending an email to contact@poopoopidoo.net. All the information necessary for the return of the goods (procedure, documents to be returned to Poopoopidoo) will then be detailed to the Customer.

Parcels for which no attached element can identify the sender (order number, surname, first name, address) cannot be taken back.
The product(s) must be returned in their new condition and original packaging, complete and accompanied by a copy of the purchase invoice. The products must not have undergone any alteration whatsoever. In addition, sale products must be returned and received by Poopoopidoo before the end of the sales period, otherwise they cannot be taken back and will be returned to the Customer.
The refund of the Customer will then intervene within 14 days from the exercise of his right of withdrawal, from the recovery of the goods by Poopoopidoo.
The costs and risks related to the return of the goods are the responsibility of the Customer who ships it. The return of the product(s) will give rise to a refund equal to the purchase price of the product(s) purchased, see the different cases in Article 13.


Article 13 – Exchange, refund


COMMANDS FOR THE EUROPEAN UNION
1)Reimbursement - general.
a) Refunds are made within 14 days of the date of the customer's refund request. The customer is reimbursed by the same means of payment as that used for his purchase.

B) Refunds of bank card payments will appear (depending on the bank institution and the customer's country) within 1-7 days on the customer's account.
Paypale refunds will appear within 7-30 days in the customer's account (deadlines are specific to paypale and beyond our control)

2)
a) Cases of non-conformity of the order
In the event that the Customer's order does not comply: error (s) of reference (s) or missing reference (s), the Customer must imperatively contact Poopoopidoo as soon as possible. In any case, unless there is a legitimate reason, any claim made beyond the 14 days following receipt of the products will be considered inadmissible and Poopoopidoo cannot be held liable.
In the event of a reference error, the Customer must return the product(s) received that are the subject of the error. In this case, in order for the return to be accepted, the Customer must inform the seller beforehand and return the products in perfect condition - unused products - within 7 days from the date of receipt. The product(s) must be returned, accompanied by the purchase invoice, or order number.
Regarding the returned product, it will be refunded or exchanged according to the Customer's request. If a refund must be made, it will be made within 14 days of receipt of your return.
In case of exchange of the product, Poopoopidoo will ship at its expense the product corresponding to the order as soon as possible (subject to available stock) and at most within 30 days of receipt of the returned product.

(B) Refunds An Order shipped
The right of withdrawal of 14 days following the date of receipt of the order applies, due to the nature of the product (manufactured on request) Poopoopidoo will refund the amount equivalent to the value of the products within 14 days but will not refund the shipping costs.
The refund will have Place 14 days after poopopopidoo receives returned products

(C) Refunds An order not shipped
Poopoopidoo will refund all sums paid within 14 days of the cancellation of the order.

2) COMMANDS FOR THE International Development (excluding the European Union)
A) For reasons of logistics and high cost of postage costs, no refund, exchange without good reason or cancellation once the order has been stocked or sent out will be possible.

B) A replacement is possible in case of damage or loss proven during transport, Poopoidoo will offer the customer various replacement options, the shipment will be at the seller's expense.

C) Customers outside the European Union have the choice between
Colissimo international: delivery time (hors preparation order) 7/15 days
Delivengo: Delivery time from 7 to 15 days, but sometimes with possible (rare) delays of up to 30 days.


Article 14 – liability
In the online sales process, Poopoopidoo is only bound by an obligation of means, its responsibility can not be engaged for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, break in service, or other involuntary problems.
Poopoopidoo cannot be held liable under the obligations of these General Terms and Conditions of Sale in the event that the non-performance of its obligations is attributable to: the unforeseeable and insurmountable fact of a third party, the fault of the Customer, or the occurrence of an event of force majeure as defined by the French courts.

Any claim filed by a user, including any Customer, against Poopoopidoo must be made within 14 calendar days of the occurrence of the event that is the subject of the complaint.

Article 16 – Force Majeure
Poopoopidoo can in no way be held responsible for the non-execution of the order in case of force majeure as defined by the French courts.

Article 17 – Electronic signature
"Double click": reiteration of the validation of the purchase order by the Customer. A purchase order completed and validated a first time is never taken into account without the confirmation of the Customer. This confirmation can be made by means of a checkbox accepting the General Terms and Conditions of Sale, or a confirmation message of the order.
The "Double Click" associated with the procedure of authentication and non-repudiation of the Customer during his order and the acceptance of these General Terms and Conditions of Sale constitutes an electronic signature within the meaning of Article 1316-4 of the Civil Code which provides: "When it is electronic, it consists of the use of a reliable identification process guaranteeing its link with the act to which it relates. The reliability of this process is presumed, until proven otherwise, when the electronic signature is created, the identity of the signatory assured and the integrity of the act guaranteed, under conditions set by decree in the Council of State. »

Article 18 – Intellectual Property
In accordance with the laws governing Intellectual Property (literary and artistic property rights, industrial property rights), this Site and all elements, trademarks, drawings, models, logos, graphics, etc. found on this Site are the exclusive property of Poopoopidoo
The reproduction or use of all or part of these elements is only authorized for the exclusive purpose of information for personal and private use, any reproduction and any use of copies made for other purposes being expressly prohibited. Any other use constitutes infringement and is punishable under Intellectual Property, except with the prior written authorization of Poopoopidoo.
